Yes, kentucky was a confederate state because it was passed by 200 delegates on the 18th of November, the so-called Act of Secession, i.e. independence themselves and for that they created a state called Kentucky Confederate in the following month followed by the beginning of a new year, and it was approved within the Confederacy as a state on the 13th.
